1. This agreement is with you, not Apple

This Agreement is concluded between you and Heart in a Cart only, and not with Apple Inc. (“Apple”). Heart in a Cart, not Apple, is solely responsible for the Apps and their content. If you downloaded an App from the Apple App Store, your use is also subject to the Usage Rules in the Apple Media Services Terms and Conditions. If this Agreement conflicts with those Usage Rules, the Usage Rules control to the extent of the conflict.

2. License

Subject to this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non-commercial entertainment on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing, where available). For Apps obtained from another app store, the license applies to devices you own or control as permitted by that store’s terms.

You may not, and may not help anyone else to:

3. Eligibility and accounts

You must be at least 13 years old (or the minimum age of digital consent where you live) to use the Services. If you are under the age of majority where you live, you must have your parent or guardian’s permission, and they agree to this Agreement on your behalf and are responsible for your purchases.

The App creates a guest account for you automatically. You may link it to Sign in with Apple or Google Sign-In to keep your progress across devices. If you do not link your account and you delete the App or lose your device, your progress may not be recoverable. You are responsible for activity on your account and for keeping access to your device and sign-in credentials secure.

4. Coins and virtual items

The Services include a virtual currency (“coins”) and may include other virtual items. Coins are earned through play, granted daily, or purchased.

Coins have no real-world value. Coins are not money or property. They cannot be redeemed, cashed out, or exchanged for money, prizes, or anything of value, and they cannot be sold or transferred outside the game. Wagering coins in Prisoner’s Dilemma is part of the gameplay; there is no way to win real money or prizes.

Ads

The App is supported by ads. Free players see one full-screen ad a day after their round, starting after their first few days of play, and may choose to watch optional rewarded ads for bonus coins. Rewarded coins are coins like any others under this section, and we may change how many ads are shown, the rewards for watching them, and daily limits at any time. Rewards depend on an ad actually being available and fully watched. Ads are served by Google AdMob on behalf of third-party advertisers, and we are not responsible for the content of advertisers’ products, services, or websites. How ad data is handled is described in our Privacy Policy.

5. Purchases and subscriptions

All purchases in the iOS App are made through Apple’s In-App Purchase system and are subject to Apple’s terms. Prices are shown in the App in your local currency before you buy. Except as required by law or by Apple’s refund policies, all purchases are final. Refund requests for App Store purchases are handled by Apple at reportaproblem.apple.com; we cannot issue App Store refunds ourselves.

Auto-renewing subscriptions

Prisoner’s Dilemma offers an optional auto-renewing monthly subscription (“Prisoner’s Dilemma+”) that provides a larger daily coin allotment, a profile badge, and an ad-free experience. The title, length, and price are shown in the App before you subscribe.

You can restore previous purchases on a new device using “Restore Purchases” in the App.

6. Player conduct and display names

Your display name is visible to other players. You agree not to choose a name, or otherwise use the Services in a way, that:

We have zero tolerance for objectionable content or abusive players. Display names are automatically screened for offensive language and for names that impersonate staff, and names that fail the check can’t be used.

Reporting a player

You can report an offensive display name directly in the app:

Every report is saved for our review. When several different players report the same name, it is automatically replaced with a neutral placeholder and that player must choose a new one. You can also report a player or any other concern by emailing info@heartinacart.com with the player’s display name. We review reports and act on them within 24 hours.

We may change any name, remove content, reset progress, or suspend or terminate accounts that break these rules. Misusing the reporting tools, such as filing false or coordinated reports, is also a violation of these rules.

7. Ownership

The Services, including the Apps, game design, software, graphics, text, sounds, and trademarks, are owned by Heart in a Cart or our licensors and are protected by intellectual property laws. Except for the limited license in section 2, we reserve all rights. If you send us feedback or ideas, we may use them without any obligation to you.

8. Maintenance and support

Heart in a Cart is solely responsible for providing any maintenance and support for the Apps, as described in this Agreement or as required by law. You can reach us at info@heartinacart.com. You and we acknowledge that Apple has no obligation whatsoever to provide maintenance or support services for the Apps.

The Services are online and require an internet connection. We may update the App, and some updates may be required to keep playing. We may change, suspend, or discontinue all or part of the Services at any time; if we discontinue a paid feature, we will give reasonable notice where practical.

9. Termination

This Agreement remains in effect until terminated. You may terminate it at any time by deleting your account from the Profile tab in the App (see our Privacy Policy) and removing the App from your device. We may suspend or terminate your access if you violate this Agreement or if we are required to by law. On termination, your license ends, you must stop using the App, and any coins or virtual items are forfeited. Sections 4, 7, and 10 through 17 survive termination.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that game data will never be lost.

If the App fails to conform to any warranty that cannot be disclaimed under applicable law, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Heart in a Cart’s sole responsibility, to the extent they are not disclaimed by this Agreement.

11. Limitation of liability

To the maximum extent permitted by law, Heart in a Cart will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or virtual items, arising out of or related to the Services. Our total liability for all claims related to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim arose or US $50.

Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in this Agreement limits rights you have under consumer protection laws that cannot be waived.

12. Product claims and intellectual property claims

Heart in a Cart, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

If a third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, Heart in a Cart, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.

13. Legal compliance

You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable laws when using the Services.

14. Third-party terms and beneficiaries

You must comply with any applicable third-party terms when using the App, such as your wireless carrier’s data service agreement. The Services rely on third-party providers (such as Apple, Google, Supabase, and RevenueCat), and we are not responsible for their services.

You and Heart in a Cart acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

15. Governing law and disputes

This Agreement is governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-laws rules. Before filing a claim, you agree to contact us at info@heartinacart.com and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Texas, and you and we consent to their jurisdiction, except that either party may bring an individual claim in small-claims court. If you live in the European Union, the United Kingdom, or another place whose laws give you the right to bring claims in your local courts or under your local law, nothing here takes away that right.
